1 Cancellation Policy
1.1 If you are a consumer (i.e. a natural person placing the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of cancellation in accordance with the statutory provisions.
1.2 Your right of cancellation is subject to the provisions specified in detail below:
Right of cancellation
You have the right to cancel this agreement within fourteen days without giving reasons.
The cancellation period is as follows:
a) If you have ordered goods, the period covers fourteen days from the date on which you or a third party designated by you other than the carrier took possession of the goods.
b) If you have ordered services, the period covers fourteen days from the date on which the contract relating to those services was entered into (unless we have commenced performance of the services as agreed with you, in which case you may not cancel any services already performed by us).
1.3 In order to exercise your right of cancellation, you must send a clear declaration (e.g. by letter, fax or email) informing us of your decision to cancel this agreement to: Volkswagen Group Charging GmbH, Mollstraße 1, 10178 Berlin, email form, Tel.: 00800 73273554. You may use the sample cancellation form attached, but this is not mandatory. You may also electronically complete and submit the sample cancellation form or another clear declaration on our website https://www.elli.eco/en/contact/contactform?brand=cupra&country=ie. If you choose this option, we will immediately send you (e.g. by email) confirmation of the receipt of said cancellation.
1.4 In order to comply with the cancellation period, it is sufficient to send the notice of cancellation before the cancellation period expires.
Consequences of cancellation
a) If you cancel this agreement, we will refund to you (except in respect of the provision of services that we have already started to perform on your instructions during the applicable cancellation period), without delay and no later than fourteen days from the date on which we receive notice of your cancellation of the agreement, all payments received from you, including (if applicable) delivery charges (excluding additional charges arising from your choice of a delivery method other than the cheapest standard delivery method offered by us).
b) If, during the cancellation period, you wish to cancel an agreement for the provision of services we have already started to perform, you must pay for the services already provided. If you have already paid for the services in full, we will refund to you without delay, but at the latest within fourteen days of the date on which we receive notice of your cancellation, all payments received from you for services that have not already been provided.
As soon as the services are completed (regardless of whether they were completed within the cancellation period), you lose your right to cancel the relevant agreement for these services.
c) We will use the same payment method for any refund as you used for the original transaction, unless expressly agreed otherwise with you, and in no event will you be charged for this refund. We may refuse a refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
d) If you have ordered goods, you must send them back or deliver them, without delay and in any case at the latest within fourteen days of the date on which you inform us of the cancellation of this agreement, to: Arvato Distribution GmbH, Wareneingang, Tor 32-38, Gottlieb-Daimlerstr. 1, 33428 Harsewinkel. The deadline is deemed to have been met if you dispatch the goods before the fourteen-day period expires.
You shall bear the direct costs of returning the goods.
You will only be liable for any depreciation of the goods if such depreciation is due to the goods being handled in a way that is not necessary in order to examine the quality, properties and functionality of the goods.
